Beyond Degrees: Allahabad High Court differentiates between beinng educated and effectively employed

In a landmark ruling on January 8, 2026 (Suman Verma vs. State of U.P.), Justice Garima Prashad of the Allahabad High Court addressed a critical loophole often used by husbands to evade maintenance under Section 125 CrPC.

The Ruling: The court held that a wife cannot be denied maintenance merely because she is "highly qualified" or possesses "vocational skills."

The Key Takeaways

  1. Potential vs. Gainful Employment: The court distinguished between the capacity to earn and actual earning. Mere employability is not a substitute for the statutory right to maintenance.

  2. The "Social Reality" Clause: The Bench observed that many women sacrifice their careers for domestic duties. Expecting them to "instantly" rejoin the workforce after years of domestic life is unrealistic.

  3. Rejection of the "Idle Women" Narrative: This judgment counters the trend of viewing maintenance as "milking the husband." It reinforces Section 125 as a measure of social justice to prevent destitution.

For years, we've seen a trend where a wife's education was used as a shield by husbands to avoid Section 125 CrPC obligations. But Justice Garima Prashad just clarified the "Social Reality."

This is something that was ann important turning point for the precedents following Section 125 of the CrPC, which provides for -  Order for maintenance of wives, children and parents.

The narrative arround maintenance has been an ever-evolving one, as the judges keep changing so does the minset by which the judgments are passed on.

Having a degree doesn't mean you have a paycheck. Sacrifice for home and kids isn't a "devilish act" for money, it's a loss of career momentum that the law must recognize.
